Right of Withdrawal

Scope

The following right of withdrawal is available to consumers within the meaning of Section 13 of the German Civil Code (BGB). It concerns paid contracts concluded via the heej platform:

• the Pro Plan (contracting party: The NEED GmbH), and
• follower subscriptions (contracting party: the respective creator; the withdrawal notice may also be addressed to us — we will forward it to the creator concerned without undue delay).

1. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (The NEED GmbH, Zettachring 12A, 70567 Stuttgart, Germany, email: info@theneed.works) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period expires.

2. Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you all payments we have received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

3. Special Notes

3.1 If you have requested that the service begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time at which you inform us of the exercise of the right of withdrawal with respect to this contract, compared with the total scope of the services provided for in the contract.

3.2 In the case of a contract for the provision of services, the right of withdrawal expires early if the trader has provided the service in full and only began performing the service after the consumer gave their express consent thereto and at the same time confirmed their knowledge that they lose their right of withdrawal upon complete performance of the contract by the trader (Section 356(4) BGB).

3.3 In the case of a contract for the supply of digital content not delivered on a tangible medium, the right of withdrawal expires early if the trader has begun performing the contract after the consumer expressly consented to the trader beginning performance before the end of the withdrawal period, the consumer confirmed their knowledge that their right of withdrawal expires upon commencement of performance as a result of their consent, and the trader has provided the consumer with a confirmation in accordance with Section 312f BGB (Section 356(5) BGB).
